The Supreme Court of India recently issued a stern warning to the Uttar Pradesh (UP) Police regarding the overlap between civil and criminal cases, expressing concern over how law enforcement handles such situations. The Court noted that in certain instances, police have been misusing their authority to intervene in civil matters, often by registering criminal cases in cases that should primarily be resolved through civil litigation.

 

The warning comes amid a growing number of cases where police have been seen as overstepping their jurisdiction, particularly in property disputes, contractual disagreements, and other civil matters. Supporters of the Court’s stance argue that this intervention is crucial for upholding the integrity of both civil and criminal justice systems. They stress that police should focus on addressing genuine criminal activities and ensure that civil disputes are directed to the appropriate courts, thereby maintaining a clear distinction between civil and criminal justice matters.
