Separatist leader Mohammad Yasin Malik was on Tuesday convicted by a Delhi court in a case related to terrorism and separatist activities in the Kashmir Valley in 2017. Yasin Malik has also been found guilty of the Unlawful Activities Prevention Act (UAPA). The court also said that Malik created a mechanism to mobilize funds from across the world to carry out terrorist and other illegal activities in Jammu and Kashmir in the name of freedom struggle. Now Yasin Malik will be sentenced on May 25.
The court ordered Farooq Ahmed Dar alias Bitta Karate, Shabbir Shah, Masarat Alam, Mohammad Yusuf Shah, Aftab Ahmed Shah, Altaf Ahmed Shah, Naeem Khan, Mohammad Akbar Khande, Raja Mehrajuddin Kalwal, Bashir Ahmed Bhat, Zahoor Ahmed Shah Watali, Shabbir Ahmed Shah formally framed charges against Kashmiri separatist leaders, including Abdul Rashid Sheikh and Naval Kishore Kapoor. The chargesheet was also filed against Lashkar-e-Taiba (LeT) founder Hafiz Saeed and Hizbul Mujahideen chief Syed Salahuddin, who have been declared absconders in the case.
Guilty of these sections –
Malik has been convicted under UAPA sections 16 (terrorist act), 17 (raising funds for terrorist act), 18 (conspiracy to commit terroristic act), and 20 (being a member of a terrorist gang or organization) and 120 . Along with this, he has also been found guilty in IPC’s B (criminal conspiracy) and 124-A (sedition). The special judge heard arguments on May 19 regarding sentencing for the charges leveled against Malik, with the maximum punishment being life imprisonment. On behalf of the special judge, it was said earlier that it has been established that Malik and others were getting money for terrorism directly.
The money was coming from Pakistan –
The court held that the money for terror funding was sent from Pakistan and its agencies and even the diplomatic mission was used to fulfill wrong designs. Declared international terrorist and accused Hafiz Saeed had also sent money for terror funding.
The accused Zahoor Ahmad Shah Watali was one of the main means of this terror funding and accused Naval Kishore Kapoor played an active role in facilitating it, working in association with terrorist organizations like Lashkar and Hizbul . According to the NIA, various terrorist organizations like Lashkar-e-Taiba (LeT), Hizb-ul-Mujahideen (HM), Jammu and Kashmir Liberation Front (JKLF), Jaish-e-Mohammed (JeM), etc. were also involved in this. Pakistan’s ISI support led to violence in the Valley by attacking civilians and security forces.
Political Front for Terrorist Activities
All Parties Hurriyat Conference (APHC) was formed in 1993 to give a political front to separatist activities. Separatist and separatist leaders including Hafiz Muhammad Saeed, the Emir of Jamaat-ud-Dawa, and members of the Hurriyat Conference were working closely with active terrorists.
Inciting youth to violence –
NIA said in the chargesheet that during investigation it was also found that APHC and other separatists were instigating the general public, especially the youth, to resort to violence to strike and even pelt stones at security forces. were. All this was done to create discontent among the people of Jammu and Kashmir towards the Government of India.
NIA also said that the investigation revealed that the separatists were raising funds from all possible sources to support the ongoing separatist and terrorist activities in Jammu and Kashmir and create unrest. The separatists were getting money from Pakistan, from terrorist organizations based in Pakistan and from local donations.
Hunger strike in Pakistan with Hafiz Saeed –
In 2013, Yasin Malik and Lashkar-e-Taiba chief Hafiz Saeed both went on hunger strike in Pakistan. Protests were organized in Pakistan to protest the hanging of Afzal Guru. Hafiz Saeed and Yasin Malik sat together in this hunger strike. There was a lot of uproar in India regarding this. After the controversy escalated, it was said on behalf of Yasin Malik that I had come to Pakistan for personal reasons. Meanwhile, the news of Afzal Guru’s hanging came. I announced a 24-hour hunger strike in front of the Press Club in Islamabad. No one had given a feast for the hunger strike. At that time, there was a demand from the BJP to cancel the passport of Yasin Malik.
Jawans attacked, conspiracy hatched –
On 25 January 1990, terrorists attacked Air Force personnel in Rawalpora on the outskirts of Srinagar. 40 people were injured in this incident while four jawans were martyred. Air Force personnel were waiting for the bus to go to the airport when the terrorists attacked them. Malik was accused of plotting a deadly attack on Air Force personnel. Yasin Malik had also mentioned this in an interview given to the international media.
Allegation of kidnapping and connection to Pakistan
Yasin Malik is also said to be involved in the abduction of Rubaiya Saeed, daughter of the then Union Home Minister Mufti Mohammad Sayeed, in 1989. Yasin Malik, the mastermind of Pakistani support and spreading unrest in Kashmir, was always trying to create havoc in the valley. Yasin Malik was also accused of taking arms from Pakistan.
