The National Investigation Agency has filed a complaint against the perpetrators under multiple sections of the IPC and UAPA after receiving the Kanhaiya Lal murder case in Udaipur from the Home ministry. The Indian Penal Code sections cited by the NIA are 295A (Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 153A (Promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc.), 452 (House-trespass after preparation for hurt, assault, or wrongful restraint), and 302 (murder), groups on grounds of religion, race, place of birth, residence, language, etc), 153B (Imputations, assertions prejudicial to national-integration), 295A (Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs), 34 (Acts done by several persons in furtherance of common intention). Similar to this, the NIA appended to the case provisions 16 (terrorist act), 18 (conspiracy), and 20 of the strict Unlawful Activities (Prevention) Act, 1967. (member of terrorist gang or organisation). The NIA has made it apparent that they are treating the case as a potential act of terrorism by including these portions. According to the NIA, a case has been brought against those accused of plotting, organising, and carrying out the atrocious murder of Kanhaiya Lal Teli on June 28 in Udaipur, Rajasthan.
The two accused, who have been detained by the police, according to the NIA, repeatedly hurt the victim with sharp objects. In order to spread fear and panic among the populace across the nation, they had also posted a video of the murderer claiming responsibility for the crime on social media, the agency said in a statement.The case was sent over to NIA earlier in the day, according to a statement from the union home ministry. The government had stated that any organization’s involvement and any connections to other countries in the murder case will be thoroughly looked into. On Tuesday, 29th of June, a Hindu man who had a tailoring business in the area was beheaded by two Muslim thugs on Tuesday in broad daylight on Udaipur’s Maldas Street. The murder was captured on camera, and the murderers uploaded the video online. He was brutally killed for posting a Whatsapp status stating that Nupur Sharma was backed by Kanhiya Lal. The assassins entered Kanhiya Lal’s shop in the video, gave him their clothing sizes, then attacked and beheaded him while it was being recorded.
